You have the right to withdraw from the contract within 14 days without giving
any reason. The withdrawal period is 14 days from the day on which the
buyer/customer or a third party named by them, who is not the carrier, has
taken possession of the goods. To exercise the right of withdrawal,
must be informed by means of a clear statement (e.g. a letter sent by post
or email) of the buyer's/customer's decision to withdraw from this contract.
Our
model withdrawal form
can be used for this purpose, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient for the buyer/customer to
send the notification of exercising the right of withdrawal before the
withdrawal period has expired.
Consequences of withdrawal: In the event of withdrawal, Radfieber must repay
all payments already received, including delivery costs (with the exception of
additional costs resulting from the choice of a type of delivery other than
the cheapest standard delivery offered by us), immediately and at the latest
within 14 days from the day on which the notification of withdrawal from this
contract was received by Radfieber. For this repayment, Radfieber will use the
same means of payment that was used in the original transaction, unless
expressly agreed otherwise with the buyer/customer; in no case will the
buyer/customer be charged any fees for this repayment.
Radfieber may refuse repayment until Radfieber has received the goods back or until the buyer/customer has provided proof that the goods have been returned, whichever is the earlier.
Bicycles that are customized at the customer’s request are excluded from the right of withdrawal. This is based on Section 312g (2) No. 1 of the German Civil Code (BGB) (formerly Section 312d (4) No. 1 BGB), which states that there is no right of withdrawal for contracts involving the supply of goods that are not prefabricated and for whose production an individual selection or determination by the customer is decisive, or which are clearly tailored to the customer’s personal needs. This applies in particular to bicycles that have been modified at the customer’s request, such as the replacement of components (e.g. saddle or handlebar), shortening of the handlebar, or the installation of permanently mounted accessories such as mudguards and luggage racks. Such customizations result in the bicycle being clearly tailored to the customer’s personal requirements and therefore excluded from return.
The goods must be returned or handed over to Radfieber immediately and in any case no later than 14 days from the day on which Radfieber was informed of the withdrawal from this contract. The deadline is met if the goods are dispatched before the 14-day period has expired. The buyer/customer bears the direct costs of returning the goods.
