General Terms and Conditions


§ 1 Scope

The following General Terms and Conditions shall apply exclusively to the business relationship between Radfieber and the buyer/customer in the version valid at the time of the order. Deviating conditions of the buyer/customer are not recognized by Radfieber unless Radfieber has expressly agreed to their validity in writing.

§ 2 Conclusion of contract

Offers of any kind are always subject to change and non-binding, unless they are expressly designated in writing as firm offers by Radfieber. They are valid while stocks last. We reserve the right to deliver equivalent goods in case of unavailability. The customer will then be informed immediately. All orders are considered as bindingly accepted only if they are confirmed in writing or by delivery with invoice.

§ 3 Shipping and delivery

Radfieber is always trying to meet specified delivery dates. However, they are not binding. Delivery is usually within 3-4 working days, in the high season, the delivery time may vary. For bicycles with equipment options up to 10 working days. Shipping is on account of the customer, unless otherwise agreed. In case of delays, the customer will be notified by e-mail of the approximate delivery date. Delivery abroad: The flat rate for shipping depends on the destination country and will be determined before the order. The customer himself is responsible for customs formalities.

§ 4 Agreement on the condition

The condition of the purchased item on which the contract is based results exclusively from the manufacturer's specifications in the respective operating instructions. Deviations require written agreement.

§ 5 Prices, due date and payment

For the end consumer, the calculation of prices, unless otherwise agreed, at the prices valid on the date of the order. Prices are final prices in EURO and include the statutory value added tax. When shipping outside the EU, the VAT will be deducted when ordering. Invoices from Radfieber are due immediately without deduction, unless another payment date is specified on the invoice. Please note: Any bank charges must be paid by the customer to ensure that the full amount is received by Radfieber. Financial purchase: The customer pays in installments after the conclusion of the financing contract (only in Germany, not possible for online purchases).

§ 6 Warranty and Liability

The customer is responsible for inspection and examination. Radfieber shall not be liable for damage caused by goods passed on without inspection, nor for the suitability of the goods supplied for the purposes envisaged by the customer, nor for damage that could arise from the processing and use of the goods. The limitation period for legal claims for defects is 2 years. The bicycles delivered by Radfieber are pre-assembled ready for shipment. Radfieber assumes no liability for the final assembly. Radfieber limits the liability in the legally permissible cases to the delivery item itself and is therefore not liable for damage that has not occurred to the delivery item itself; in particular, Radfieber is not liable for loss of profit or for other financial losses of the buyer/orderer.

§ 7 Right of revocation

The online buyer/orderer has the right to revoke the contract within 14 days without giving reasons. The revocation period is 14 days from the day on which the buyer / purchaser or a third party designated by him, who is not the carrier, has taken possession of the goods. by means of an unequivocal statement (eg a letter sent by mail, fax or e-mail) about the decision of the buyer / purchaser to revoke this contract. For this purpose, our Sample cancellation form [PDF can be opened by clicking here] can be used, but this is not mandatory.

To comply with the withdrawal period, it is sufficient that the buyer / purchaser sends the notice of exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of revocation: In the event of revocation, Radfieber must repay all payments already received, including delivery costs (with the exception of additional costs resulting from the fact that a type of delivery other than the most favorable standard delivery offered by us was selected), without undue delay and at the latest within 14 days from the day on which the notification of the revocation of this contract was received by Radfieber. For this repayment, Radfieber will use the same means of payment that was used in the original transaction, unless expressly agreed otherwise with the buyer/customer; in no case will the buyer/customer be charged any fees due to this repayment.

Radfieber may refuse repayment until Radfieber has received the goods back or until the Buyer/Customer has provided proof that the goods have been returned, whichever is the earlier.

The goods must be returned or handed over to Radfieber without delay and in any case no later than 14 days from the day on which Radfieber was informed of the cancellation of this contract. The deadline is met if the goods have been sent before the expiry of the period of 14 days.

The buyer bears the shipping costs for returning products back to us. Since bicycles are shipped in large boxes, shipping costs are significantly higher compared to normal packages. Shipping costs for returning a bike from within Germany is around 100€ and around 200€ if you return from outside of Germany. We can either arrange shipments for returning bikes with our vendors or customers can arrange shipments by themselves.


§ 8 Return Consequences

The purchase contract is cancelled after the return or redemption of the goods, and Radfieber repays any payments already made within 14 days by bank transfer. For this repayment, we will use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment. The consumer shall bear the costs of the reduction in value if this is not exclusively due to the examination of the ordered goods, as would have been usual in a retail store, for example. In all other respects, the obligation to pay compensation can be avoided by the customer not using the goods as an owner and refraining from doing anything that could impair their value.

§ 9 Validity of contractual provisions

The invalidity of one or more provisions of these General Terms and Conditions shall not affect the validity of the remaining provisions.

§ 10 Applicable law

The law of the Federal Republic of Germany shall apply exclusively to all business relations.
